We, Hamad bin Khalifa Al-Thani, Emir of the State of Qatar,
Having perused the Amended Provisional Constitution, in particular articles 23, 34, and 51 thereof,
Decree-Law No. 10 of 1993 regulating the Ministry of Public Health and defining its functions,
Decree No. 35 of 1979 concerning Hamad Medical Corporation, as amended by Decree No. 38 of 1987,
The proposal of the Minister of Public Health,
The draft law presented by the Council of Ministers, and
After taking the opinion of the Shura Council,
Hereby promulgate the following law:


Articles

Article 1


 Smoking shall be prohibited in the Ministry of Public Health and its subsidiary Institutions and Agencies.
As an exception, by a resolution of the Minister of Public Health, certain places may be allocated for smoking at these bodies.


 

Article 2


 A fine of two hundred (200) Riyals shall be imposed on any person who violates the provisions of this Law or the resolutions that give effect thereto. The sanction shall be doubled in the case of repetition


 

Article 3


 Employees of the Ministry of Public Health and Hamad Medical Corporation, who are delegated by the Minister of Public Health - by means of a resolution - shall have the capacity of law enforcement officers in enforcing and establishing the occurrence of offences committed in violation of the provisions of this Law and the resolutions that give effect thereto.
Such employees may effect a settlement with the offender to pay half the fine prescribed in the preceding article, within three days from the date of the compounding being submitted to him in writing.
The criminal case shall terminate upon payment of this amount. In the case of rejection of the compounding by the offender or his failure to implement the same within the time limit specified the matter shall be brought to trial.


 

Article 4


 The Minister of  Public Health shall issue the resolutions necessary for the implementation of the provisions of this law.


 

Article 5


 All relevant authorities, each within its own jurisdiction, shall implement this law which shall be effective thirty days from the date of its publication in the Official Gazette.
