Articles
1 Article
In the application of the provisions of this Law, the following words and phrases shall have the meanings assigned to each, unless the context otherwise requires:
“The Corporation” means Qatar General Electricity and Water Corporation.
“The Board” means the Board of Directors of the Corporation.
“The Competent Department” means the competent administrative unit in the Corporation.
“The Subscriber” means the owner or tenant of the building or facility,
whether a natural or juristic person,
who contracts with the Competent Department to provide electricity or water service, or both.
2 Article
1.
The Corporation shall be in charge of the works of electricity and water supply to the buildings and facilities, and of any additions, changes or conversions therein. It shall also undertake the connection of such works to the public network or the disconnection therefrom.
No entity other than the Corporation may conduct such works without a licence in accordance with the provisions of this Law and the bylaws and regulations of the Corporation, and in accordance with the conditions specified in the licence.
3 Article
The Subscriber shall take all measures and precautions to ensure and protect the service meter cabinet (electricity or water),water valve chamber, electrical rooms, low-voltage rooms, transformers and sub-stations, as the case may be; to connect service to the buildings or installations attached thereto; and to maintain them in accordance with the conditions and specifications issued by the decision of the Board.
4 Article
The Subscriber shall be prohibited, after completion of the works of electricity or water supply to the buildings or facilities, and without the consent of the Competent Department, from:
Performing any act that adds a load to the electrical loads connected to the buildings or facilities in excess of the permitted loads.
Making any modifications to the circuit breaker, meter, low-voltage boards, water connections, water chamber valves, switchgear or other connected equipment in order to change the purpose for which the buildings or facilities are used; or using other electrical stations or installations related to electricity or water for purposes other than those intended.
5 Article
Where the Subscriber violates the prohibitions contained in the previous article, the Competent Department shall take the following actions:
Where the overload resulting from the violation does not exceed 10 kw with no resulting damage, the Department shall notify the Subscriber to remedy the violation. The Subscriber shall pay the prescribed penalty within fifteen days from the date of being notified in accordance with the decision of the Corporation. Where payment is not made and the violation not remedied during this time period, the Corporation may cut off the Subscriber's electricity supply until the remedial action and payment have been satisfied.
Where the overload exceeds 10 kw and resulted in damage, the Corporation shall notify the Subscriber to remedy the violation and pay the prescribed penalty within fifteen days from the date of notification in accordance with the decision of the Corporation. The Subscriber shall also pay the following additional penalties:
One thousand (1,000)Qatari Riyals where the additional overload is for one meter for residential purposes.
Two thousand (2,000)Qatari Riyals where the additional overload is for one meter for non-residential purposes.
Where payment is not made and the violation not remedied during the aforesaid time period, the Corporation may cut off electricity until the remedial action and payment have been satisfied.
Where the Subscriber commits either violation more than once, the penalty shall be doubled.
Where the overload may endanger life or property, the electrical current shall immediately be cut off until the remedial action and payment have been satisfied. In addition, the prescribed penalty shall be doubled and the Subscriber obliged to pay for any repairs to damaged property and/or necessary re-installation costs and expenses, without prejudice to the owner's right of indemnity.
Where the Subscriber violates the prohibition set out in paragraphs 2 and 3 above, the Competent Department may disconnect the electricity or water supply until the situation is remedied by the offender and he has paid the prescribed fees.
6 Article
Where the Subscriber violates the rules of electrical or water supply connections issued pursuant to the decision of the Board, the Competent Department may disconnect such supply until the Subscriber corrects the violation and pays the prescribed penalties and any expenses incurred by the Corporation as a result of the violation.
7 Article
Where the Subscriber, in contravention of the provisions of this Law, establishes electrical or water connections to provide his home, business or other facility with power or water other than through his authorized meter, he shall be liable to pay the following penalties:
1. One thousand (1000) Riyals for a water meter between one-half and three- quarters of an inch, or for a single-phase electricity meter.
2. Two thousand (2000) Riyals for a water meter between one and one-and-a-half inches, or a three-phase electricity meter from 3 X 50-10 amps to 3 X 500 CT/5 amps.
3. Five thousand (5000) Riyals for a water meter two inches and above, or a three-phase electricity meter of 3CT X 800/5 amps and above.
8 Article
Staff of the Corporation authorized by law to act as judicial enforcement officers, pursuant to the decision of the Attorney-General in agreement with the Chairperson of the Board of Directors, shall be entitled to seize and prove violations of the provisions of this Law and its implementing decisions, and to take the stipulated actions in this regard.
9 Article
Without prejudice to any greater penalty prescribed by law, any person convicted of illegally connecting electricity or water from the public water and electricity network, either for their own building or facility or for the building or facility of their affiliates, shall be sentenced to imprisonment for not more than three years or to a fine of not less than ten thousand Riyals and not more than fifty thousand Riyals, or to both penalties.
10 Article
A sentence of imprisonment for not more than three months, or a fine of not less than five thousand (5,000) Riyals and not more than ten thousand (10,000) Riyals, or both, shall be imposed on any person who:
Contravenes the provisions of
Article 2
of this Law.
Provides incorrect data or documents for obtaining electricity or water supply.
11 Article
1.
The Corporation may conduct compounding for the violations set forth in the preceding two Articles either before the commencement of criminal proceedings or during the Court's deliberations prior to delivering its final verdict.
Such compounding shall be against payment of the exact amount corresponding to the violations as prescribed by the
schedule annexed
to this Law.
12 Article
The Chairperson of the Board of Directors shall issue the decisions necessary for the implementation of the provisions of this Law.
13 Article
All provisions contrary to this Law shall be cancelled.
14 Article
All competent authorities, each within its jurisdiction, shall enforce this law from the date of its publication in the
Official Gazette
.
