Freedom of use of protected works

17 Article

The following uses of the protected works shall be legal even if they are not accompanied by the consent of the author:

1- Getting the assistance of the work for only the special personal use by copying, translation, adaptation, musical arrangement, acting, broadcast listening, television watching or photography in any other form;

2- Getting the help of the work for explication in education through publications and programs, broadcast or television recordings, or movies; for educational, instructive or religious purposes or for vocational training, within the limits required by the achievement of such purposes, provided that the use is not intended to achieve financial gain, in addition to mentioning the source and the author's name;

3- Quoting paragraphs of the work in another work with the purpose of illustration, explanation or criticism, and within the limits of the norm, and in the extent which is justified by such purpose, provided that the source shall mention the author's name. The same is applied on the paragraphs taken from press articles and periodicals which are declared in the form of press summaries; and 4- Taking new images for anything previously photographed and publishing the image even though the new image is taken in the same place and in the same circumstances in which the first image has been taken.

18 Article

It may be possible, without the permission of the author to reproduce the news articles, political, economic, social, cultural or religious articles published in newspapers or periodicals. In addition the broadcasting works of a similar nature, provided that the source and the author's name are clearly mentioned, if any.

It shall be permitted to reproduce any work which can be watched or listened to during the presentation of current events, by photography or television show or any other mass media, provided that is the same should be within the limits of informational objective to be achieved, with reference to the name of the author

19 Article

It is permissible for public libraries, non-commercial documentation centers, educational institutes and scientific and cultural institutions without the author's permission to reproduce works protected by photography or by a similar method, provided that the reproduction and the number of copies are limited to the needs of their activities, and not to the detriment of exploitative material of the work, and does not cause harm the legal interests of the author.

The organizations of radio and television broadcasting may prepare a temporary recording of any work for their programs by their own methods having been permitted to broadcast thereof.

20 Article

The press and the other mass media means shall publish, -without the permission of the author, the speeches and lectures, as well as pleadings delivered during judicial disputes, and other similar works, openly communicated to the public, provided that the author's name is mentioned clearly. The author alone shall have the right to publish these works in one volume, or in any other way he deems appropriate.

21 Article

The author while publishing his work may not prevent the display, performance, representation, throwing in a family meeting, or an association, a club or school; provided that such display, performance, representation or throwing does not produce any financial revenue, directly or indirectly.

The musical bands of the military forces other teams of the state, or other public persons, without the permission of the author may perform the work after its publication, as long as such playing or performance does not produce any financial revenue, directly or indirectly.
