1 Article
Notwithstanding the provisions of the aforementioned
Criminal Procedure Law
, in crimes involving state security, honour, decency or public morals, the Minister of Interior may, on the basis of a report submitted by the Director of Public Security, order the provisional detention of the defendant if there exist well founded reasons to believe that the defendant may have committed the crime(s) with which he/she is charged.
2 Article
The duration of the provisional detention shall be two weeks, extendable for additional similar period or periods to a maximum of six months. The duration may be extended for an extra period not exceeding six months with the consent of the Prime Minister.
The period of provisional detention shall be doubled if the offence relates to state security.
3 Article
Both the detainee and his family may appeal in writing to the Prime Minister against the decision of detention or extension thereof.
4 Article
The detainee shall be held in temporary custody for the duration of the detention. If the detainee is put on trial and a custodial sentence imposed, the period of provisional detention shall be deducted from the imposed sentence.
5 Article
6.1 The Regulatory Tribunal, represented by the president, may form a registry for the Tribunal and the president shall appoint a head thereof for a period not exceeding five years.
6.2 The president of the Regulatory Tribunal, together with the head of the registry, may form the registry of the Tribunal and appoint the registrar thereof, in order that the court of organization and the civil and commercial courts may engage in their respective functions.
6.3 The Tribunal registrar shall be responsible for the administrative aspects of the Regulatory Tribunal, as well as for the management of appeal cases before the Regulatory Tribunal, in addition to all the requirements of the president or judges to perform their duties.
6.4 The Tribunal registrar shall assume office in accordance with the conditions and provisions determined by a resolution of the president. If appointed by the court and the Regulatory Tribunal, he shall assume office in accordance with the conditions and provisions determined by a resolution of the president and the president of the civil and commercial courts.
6.5 The president may dismiss the Tribunal registrar based on the justifications leading to the dismissal of the president or judges, as provided in item 6 of
Supplement no. 5
under the law of QFC. Where a material violation has been committed, the president shall decide the extent of such violation and whether it shall result in the registrar's dismissal from office.
6.6 Where the president deems it necessary to appoint a deputy Tribunal registrar, he may make such appointment, provided that the Tribunal registrar shall delegate some of his responsibilities to the deputy if deemed appropriate. Furthermore, the president may appoint a deputy Tribunal registrar on behalf of the civil, commercial and organization courts.
6.7 All references to the Tribunal registrar hereunder shall also mean the deputy Tribunal registrar assuming office based on assignments delegated thereto.
6 Article
All competent authorities, each within its jurisdiction, shall implement this law, which shall enter into force thirty days after the date of its publication in the
Official Gazette
.
