The Governments of the State of Qatar and the Islamic Republic of Pakistan,
Believing that promotion and expansion of employment opportunities of the Pakistani manpower in the State of Qatar will result in consolidating of mutual cooperation in the best interests of their citizens,
Desiring to amend and update the provisions of the Agreement between the Government of the State of Qatar and the Government of the Islamic Republic of Pakistan concerning the Organization of Pakistani Manpower Employment in the State of Qatar signed on 28 March 1987, (hereinafter referred to as "the Agreement")
Have agreed as follows:
Article (1)
This Additional Protocol amends and adds to the provisions of the Agreement.
Article (2)
The Ministry of Labour and Social Affairs of the Government of the State of Qatar and the Ministry of Labour, Manpower and Overseas Pakistanis, Government of the Islamic Republic of Pakistan shall represent the State of Qatar and the Islamic Republic of Pakistan in all matters relating to the implementation of the Agreement.
Article (3)
(i) The Parties shall review from time to time, through the Joint Committee referred to in Article (16) of the Agreement, the possible employment opportunities in the State of Qatar, including general information regarding development plans in the State of Qatar, projected employment opportunities thereunder for particular labour categories or skills, the expected duration of these employment opportunities and the willingness of Pakistani citizens to make use of them.
(ii) The Joint Committee referred to in Article (16) of the Agreement shall meet once a year, alternately in each of the two States.
Article (4)
(i) The Government of the State of Qatar may adopt procedures and take steps to repatriate Pakistani workers on the expiry of their contracts of employment. It may adopt procedures and take similar steps before the expiry of the duration of the contracts when the needs for the employment comes to an end.
(ii) Before taking steps as mentioned in paragraph 1, the Qatari authorities will make efforts to adjust such workers with different firms. In case they do not succeed in this regard, the Qatari authorities shall ensure that the wages of the workers and other rights accruing to them under contracts of employment and the labour law of the State of Qatar are paid to them before repatriation.
Article (5)
The Government of the State of Qatar may repatriate any number of Pakistani workers if their presence in the State of Qatar becomes contrary to public interest or the national security of the State, provided their wages and other rights accruing to them under the contract of employment and the labour law of the State of Qatar are paid to them before repatriation.
Article (6)
This Additional Protocol, which shall be considered as an integral part of the Agreement, shall remain in force for the duration of the Agreement. It shall enter into force from the date of its signature by the authorized representatives of the two Parties.
Concluded in two original copies in the Arabic and English languages, both texts being equally authentic. In case of divergence in the texts or difference in interpretation, the English text shall prevail.
Done at Islamabad on 28 Rabia II, 1429 AH, corresponding to 4 May 2008 AD.
